247-25-000306-CU, 307-LM, 308-V - Dock and River Setback Variance

Proposal Summary

The applicant requests a Conditional Use Permit to expand a dock, and for the associated fill and removal within the floodplain and the banks of the Deschutes River. The applicant also requests a Variance for play structures that were constructed within 100 feet of the ordinary high water mark of the river. Finally, the applicant requests Landscape Management Review for accessory structures that were constructed on the property.

The subject property is located at 17133 Blue Heron Drive. It is identified as Tax Lot 1100 on Assessor's Map 20-10-24A.

Proposal Status

The Hearings Officer's decision was issued on March 27, 2026. The Hearings Officer denied a Conditional Use Permit for the dock but found that it was a lawfully-established nonconforming use. The Landscape Management application was approved and the Variance to the 100-foot river setback was denied.

 A public hearing before a Hearings Officer was held on December 4th and the written record was left open after the hearing. On December 31, 2025, the applicant submitted a Modification of Application (file no. 247-25-000767-MA). Because this Modification involves new criteria that applies to the application, the Hearings Officer determined that the record should be reopened and a new hearing date set. A continued hearing was subsequently held on February 5, 2026.
