Proposal Summary

A land use action review to amend the Final Master Plan (FMP) for the Thornburgh Destination Resort by amending the Fish and Wildlife Management Plan (FWMP) and imposing limitations on the scope of development and water use allowed by the Thornburgh Destination Resort.

Proposal Status

The application was received by the Planning Division on August 17, 2022. A public hearing was conducted by a Deschutes County Hearings Officer on October 24, 2022. A recording of the hearing can be viewed here. On December 19, 2022, the Hearings Officer denied the Applicant’s request. Two appeals of the Hearings Officer's decision have been received. The Applicant filed an appeal on Friday, December 30, 2022 (ref. Appeal No. 247-22-000984-A) and an appeal was filed by A. Gould on Tuesday, January 3, 2023 (ref. Appeal No. 247-23-000003-A). The Board of County Commissioners (BOCC) conducted a public hearing on February 1, 2023.  A recording of the hearing can be viewed here. 

The BOCC held deliberations on Wednesday, March 29, 2023 and voted 2-1 to approve the Applicant's request. A recording of the meeting can be viewed here. The Board's final decision was approved and mailed on April 17, 2023.

On January 12, 2024, the Land Use Board of Appeals (LUBA) issued their Final Opinion and Order remanding the County's decision back to the County for further review (ref. LUBA Nos. 2023-038, 2023-039, 2023-041). LUBA's decision has been appealed to the Oregon Court of Appeals.
