Proposal Status
The remand application was initiated on July 28, 2023. A public hearing was held on August 30, 2023. On October 10, 2023, the Hearings Officer found the Applicant met its burden of proof demonstrating that all criteria applicable to the proposed use have been satisfied and approved the conditional use sought in the Application, subject to the conditions of approval set forth in the Original Decision.
On October 20, 2023, the County received an appeal of the Hearings Officer's decision. However, the Board of County Commissioners declined to hear the appeal. The County's remand decision was appealed to LUBA and, ultimately, LUBA affirmed the County's remand decision and approval of a template dwelling on the subject property.
