Proposal Summary

The applicant requests to amend the Conceptual Master Plan/Final Master Plan (CMP/FMP) for the Thornburgh Destination Resort. The requested modification changes the required minimum ratio of Overnight Lodging Units (OLUs) per single-family dwelling unit from from 2:1 to 2.5:1 to match the current State and County Destination Resort Rules.

Tax lots 5000, 5001, 5002, 7700, 7701, 7800, 7801, 7900 and 8000 on Deschutes County Assessor’s Map 15-12-00.

Proposal Status

In October 2021, the Deschutes County Planning Division administratively approved the modification request. An appeal was filed and the Hearings Officer denied the issues on appeal (appeal no. 247-21-000920-A) and approved the Modification. The Hearings Officer's decision was appealed to the Board of County Commissioners (BOCC / appeal no. 247-21-001116-A). The BOCC declined review of the appeal (Order No.2022-003). The County’s decision was then appealed to the Land Use Board of Appeals (LUBA). In June 2022, LUBA affirmed the County’s decision (LUBA No. 2022-011). The Court of Appeals affirmed without opinion LUBA’s decision (A179306). The Oregon Supreme Court declined review (S069813). Therefore, this Modification approval is final.
