Proposal Summary

Land Use Compatibility Review for an extension of community sewer services, located in the public road right-of-way, to the entire Unincorporated Community of Tumalo.

Road Right-of-Way throughout the Unincorporated Community of Tumalo.

Proposal Status

A public hearing was conducted by a Deschutes County Hearings Officer on February 22, 2022. The Hearings Officer’s decision was issued on April 7, 2022.  Two (2) appeals of the Hearings Officers decision were filed (ref. appeal numbers 247-22-000324-A and 247-22-0003235-A). The Board of County Commissioners declined to hear the appeals (ref. Board Order No. 2022-022).

An appeal was filed to the State of Oregon Land Use Board Appeals (LUBA). LUBA found the County correctly categorized the use and land use review requirements. The appellant requested the appeal be transferred to Deschutes County Circuit Court and LUBA granted this request.
