247-21-000937-A Deschutes County Board of Commissioners Decision Whether to Hear Appeal

Proposal Summary

At an August 24, 2021 public hearing, Deschutes County Hearings Officer heard an appeal on remand from the Oregon Land Use Board of Appeals (LUBA 2018-140) and the Oregon Court of Appeals (Appellate Judgement and Supplemental Judgement A171603). The Hearings Officer issued a remand decision October 4, 2021 to approve 247-21-000731-A (the Tentative Plan for Phase A-1 of the Thornburgh Destination Resort), thus clarifying and affirming the county's past approval of 247-18-000386-TP, 18-000454-SP, and 18-000542-MA. An appeal was filed by Annunziata Gould October 15, 2021 requesting the Deschutes County Board of Commissioners hear, consider, and reverse the Hearings Officer remand decision through a de novo hearing. The Board of County Commissioners may choose whether to hear this appeal locally or send it directly to the Oregon Land Use Board of Appeals.

Proposal Status

In August 2021, the Applicant initiated the subject remand application. The Hearings Officer issued a remand decision addressing the issues on remand and thus clarifying and affirming the County's past approval of 247-18-000386-TP, 18-000454-SP, and 18-000542-MA (the Tentative Plan for Phase A-1 of the Thornburgh Destination Resort). The Board of County Commissioners declined to hear an appeal (ref. Order No. 2021-059). The County’s decision was appealed to the Land Use Board of Appeals (LUBA). LUBA affirmed the County’s decision (LUBA No. 2021-112). However, a petition for judicial review has been filed to the Oregon Court of Appeals.
