A public hearing was held on November 30, 2021. The Hearings Officer decision approving the applicant's proposal was issued on January 28, 2022. An appeal of the Hearings Officer decision was received on February 9, 2022 (ref. Appeal No. 247-22-000109-A). On February 23, 2022 the Board of County Commissioners declined to hear the appeal.
In July 2022, the Land Use Board of Appeals (LUBA) remanded the decision (ref. LUBA Case No. 2022-022) . The Oregon Court of Appeals affirmed LUBA's decision. The Applicant initiated a remand application and ultimately the requested dwelling was approved.
