Measure 37 Information
 
If you are considering submitting a claim for compensation to Deschutes County, the following information will assist you in filing a claim.

 

It is the intent of the County to work with claimants in a cooperative manner toward resolution of each claim.  While some of the material requested as part of a claim submittal might appear burdensome, it is necessary in order for the County to render a thorough decision, while minimizing delays in the process.

  • Obtain the claim form through the Community Development Department, located at 117 NW Lafayette Avenue, Bend, OR  97701 or

  • Download the Measure 37 Claim Form from the County’s website.
  • Once a claim is filed, the measure gives the County 180 days to make a decision.  The County may choose to pay compensation or “modify, remove, or not ... apply the land use regulation or land use regulations to allow the owner to use the property for a use permitted at the time the owner acquired the property.”
  • As stated in the measure, some land use regulations are exempt from Measure 37 claims.
  • Once you have completed the County’s claim form and attached copies of all required documentation, submit the form and your supplemental materials to the Community Development Department. The claim must be accompanied by a fee of $750.00
  • Once you submit your claim, it will be reviewed and processed by various departments, including County Counsel and Community Development. Your claim will be processed within the required 180-day time frame, in the order received. 
  • Once the claim review is complete, the County Administrator’s office will notify you of the date set for Board of Commissioners review of your claim.
  • For purposes of claim review, the Claimant Owner or Agent will be designated as the primary contact for purposes of communication, correspondence and notices pertaining to the claim.
  • Due to the number of claims that could potentially be submitted, the status of your claim cannot be reported until a final determination is made by the Board of Commissioners.
  • In recognition that many of the land use regulations implemented by Deschutes County are derived from the laws and administrative rules of the State of Oregon, it is the policy of the County to advise individuals seeking compensation to file simultaneous claims against the State of Oregon in accordance with procedures established by law.
