Oregon's Smokefree Workplace Law
"Protecting employees and customers from secondhand smoke"

 

CHANGES IN OREGON'S SMOKEFREE WORKPLACE LAW

(ORS 433.835-870) is effective January 1, 2009

 

The law expands the list of indoor workplaces required to be smokefree to include:

  • Bars and bar areas of restuarants
  • Bingo halls
  • Bowling centers
  • Employee breakrooms
  • 75% of hotel/motel sleeping rooms
  • Fraternal organizations
  • Any business or organization open to the public
  • Any business or organiation with one or more employee
  • Any place of employment: every enclosed area under the control of a public or private employer that employees frequent during the course of employment.

 

Smoking in not allowed in any enclosed area regardless of ventilation that is open to the public.  An enclosed area is any structure with a ceiling and three or more walls (permanent or temporary and made of any material).

 

In addition, smoking is not permitted within 10 feet of any entrance, exit, window or air intake vent.

 

This is the state minimum, municipalities, businesses and property owners can expand the law beyond the Smokefree workplace law. 


HOW TO COMPLY

Each business is required to post signs at each entrance providing notice that smoking is prohibited with 10 feet.

Employees or the public can file a complaint confidentially by calling 1-866-621-6107 or by completing an online complaint form at www.healthoregon.org/smokefree
