Formal Accountability Agreement

For those youth whose case is not referred to Court, the matter may be addressed by an Intake and Victim Services officer through a Formal Accountability Agreement. If a youth is already on probation, their community justice officer reviews the case with the Deputy District Attorney to determine how to proceed with the case.

Following Oregon Revised Statute (ORS) 419C.230:

"A formal accountability agreement may be entered into when a youth has been referred to a county juvenile department, and a juvenile department counselor has probable cause to believe that the youth may be found to be within the jurisdiction of the juvenile court..."      

A Formal Accountability Agreement is a voluntary contract between a youth and Deschutes County Juvenile Community Justice, whereby the youth agrees to fulfill certain conditions in exchange for not having a petition filed in Court against the youth. Parents or guardians are also considered to be a party to the contract and must agree to the terms.

When eligible for a Formal Accountability Agreement instead of Court action, the youth is directed to an intake interview to determine the terms of the agreement. Generally, an agreement is for three to six months and the terms must be completed within one year. Several factors are considered when establishing the contract conditions:
 
  • Level of crime
  • Criminal history of youth
  • Victim input
  • Risk score of youth
  • Current circumstances
